also that he would be given the purchase money according as they were sold but he refused, kept the cattle himself and sold them in the Dublin market. That soon after Mr. Newborough came to Dublin when Plt. told him about the above proceedings and demanded the return of the bonds, whereupon Mr. Newborough replied he wanted £9 before he would deliver up the same to Plt., but did promise he would abate Plt. the £5 only which he had lost on the first sale of cattle. That Plt. soon after served Mr. Newborough with a copy of subpoena out of the Chancery of this Hon. Court to recover Plt’s bond and Mr. Newborough did thereupon assault Plt. tearing off his clothes and the glove of Plt’s hand, and afterwards had Plt. arrested upon a capias audrend issued out of the Common Pleas at suit of Mr. Newborough to recover £150. That Plt. was a prisoner for 16 days in the Marshalsea of Dublin upon said writ. That Mr. Pepard who is Mr. Newborough’s attorney offered to deliver to Plt. all Plt’s bonds and papers for the sum of £6 which offer Plt. refused because Plt. does not owe anything. That Plt. has often demanded the return of his bonds and papers and the rest of the bullocks from Mr. Newborough but he refuses to deliver them. Prays that a writ may be gtd agst Brockhill Newborough, Esq. to answer in the premises. Entered 25 January 1690 [-1].
Prerogative Will:
Francis Bradston.
My lands and all other my real estate whatsoever to my son Thomas Bradston and his heirs, he to pay thereout the portion and legacy and debts now due by me, viz: £300 to my daughter Margaret Bradston at her day of marriage or when she is 15, and £100 to my sister Dorothy Bradston to be paid to her after such debts as in annexed schedule [missing] are paid.
I appoint my wife Mary Bradston sole exi~x and guardian over my children during their respective minorities, and half my substance to my wife and the other half equally to my children.
