Beatty, that Arthur agreed by deed dated 19 March, 1732[-3] in conson (consideration) of the sum of £400 to be paid to Arthur Beatty (father to Plt.) by Plt. he did assign to Plt. said lands to hold to Plt. for the residue of said terms. That Plt. entered upon the premises and received the rents thereof for some time. That by said deed one James Young of Drumgoon, gent. was appointed to give Plt. livery and seizer of Farranseer whereby Plt. became possessed thereof, and Plt. also held said lands of Glasloscan and Annagh and did register said deed on 8 May 1733. That said lands were worth £40 yearly profit. Now so it is Plt’s said father notwithstanding Plt’s said title to the premises would not permit Plt. to receive the profit thereof and the lives in the lease of Farranseer being very aged and infirm said Arthur Beatty surrendered the lease and took a new lease of Farranseer for the life of Arthur Hamilton in his own name which life is still in being, and Plt. charges that said lease so taken by Arthur was in trust for Plt. That Plt. was an obedient and filial son did not disturb his father in possession of the lands. That Plt’s said father died 8 May 1741 having made his will. But before Arthur Beatty died he got said deed from Plt. and devised said lands to David Beatty younger brother to Plt. to the value of £1,000 and said David Beatty has seized same and retaining said lands has combined with one William Trimble joint exor with him in the said will of Arthur Beatty will not give Plt. possession of said lands. That Plt. paid £400 to his father for said lands & ought to have them. Prays for writs agst David Beatty & Wm. Trimble to answer in the premises.
