still holds the lands of Toolcurlick by virtue of said deed. That PLT. has brought an ejectment in the Court of Exchequer to recover said lands and Bryan Maguire has appeared to defend his title to Edenmore, Cullens and Killcullow, and Deft. Rowland Betty has appeared to defend his title to Ardverny, and Ferrardle; and said Bryan Maguire and Rowland Betty combine to defraud PLT. and have got all the title deeds in their hands and say that if PLT. proceeds further in said cause they will evict PLT. out of the lands of Toolcurlick, and they pretend that Conconaght Maguire was at one time seized in fee of all said lands by a title prior to John Betty and that he settled same on Deft. Bryan Maguire. Whereas if Conconaght Maguire was seized of said lands he conveyed his title therein for a valuable conson to said John Betty long before such a settlement if any such was made on Bryan Maguire. At other times Bryan Maguire and Rowland Betty pretend that said John Betty by deed conveyed said lands or at least Ardverny and Ferrardle and his tithe thereto to said Bryan Maguire and Rowland Betty or to one of them and that it was prior to the conveyance of John Betty to PLT. Whereas if such was that case it was a deed of conveyance long since revoked. Now so it is Defts have all the deeds in their hands and say that John Betty from when PLT derives his title had no estate in the premises, whereas PLT avers he has a good estate which would appear by the title deeds. Pray that writs may be granted against Rowland Betty, Bryan Maguire and John Betty to produce said titles deeds and answer in the premises. Bill entered 20 Feb. 1706 [-7].

Plaintiffs William Beatty, William Wylye, William Harknesse, Joseph Wright, John Crookes, James Harknesse, James Johnstons, David Starrett, and William Mills, of the parish of Lissan, farmers, shew. That Rev. Adam Usher, Cleric being rector to the united parishes of Lissan and Dissartlin and thereby intitled to the tithes of said parishes did by article dated 22 March 1696[-7] made by Adam Usher to PLTs and to one Henry Burnett, since deceased, to farm let to PLTs and said Henry Burnett, deceased, all the tithes great and small and all other ecclesiastical dues whatsoever (Glebes excepted) of the parish of Lissan, to hold from 1st Nov. then last part at £70 rent excepting in said demise the tithes great and small due to Sir Robert Staples, Bart., and Mr. John Walker.
