Prerogative Will [Beatty MS 8]
David Beatty of Raheenduff, Co. Wexford, Esq.
Whereas by indenture of settlement dated 9 Sept. 1816 on my marriage with my dear wife Elizabeth Beatty alias Martin certain funds therein specified were vested in Thomas Beatty and Henry Martin; now the Rev, Henry Martin, on trusts therein mentioned, inter alia, to pay after my decease £300 per annum to my said wife for her life, with power reserved to me to bequeath said funds to the children of said marriage as by will I shall direct.
Whereas there are now five children of said marriage living: viz: David Beatty, John Thomas Beatty, Mary Beatty now Fitzgerald, Olivia Maria Beatty now Milward and Elizabeth Susan Beatty. Whereas on the marriage of my said daus. Mary and Olivia Maria I appointed to them £1,500 each part of said trust funds, which I hereby ratify as their share thereof.
I appoint 5/- of said trust fund to my eldest son David Beatty he being already provided for.
I appoint £1,500 to my third daughter Elizabeth Susan Beatty.
I appoint the lands of Rathangan, Co. Wexford, one other part of said property to my son John Thomas Beatty, charged with £500 for my said dau. Elizabeth Susan Beatty, which £500 is in addition to the above £1,500.
I appoint the several houses and premises in the city of Dublin being another parcel of said trust properties to my said three daus. Mary Beatty now Fitzgerald, Olivia Maria Beatty now Milward, and Elizabeth Susan Beatty share and share alike.
The residue of said trust funds to my said dau. Elizabeth Susan Beatty.
Said sums and properties to be subject to said annuity of £300 to my wife.
Whereas I am entitled to a share in the lands of Rathangan under the will of my late brother-in-law Thomas Peyton Slapp, I bequeath my interest therein to my said son John Thomas Beatty.
Whereas I am also entitled to a share in houses in the city of Dublin by deed of assignment from my brother Edward Beatty and also to a further share therein under the will of my said brother-in-law, I bequeath said share to my said dau. Elizabeth Susan Beatty.
I bequeath to my eldest son David Beatty all my estate and interest in the lands of Rorodale, Co. Wexford.
