second grandson said Thomas Beatty for life, then to his heirs male; remainder to Plts successively; remainder to his said first grandson Edward Beatty; and did bequeath the residue of his estate real and personal to Plts Equally, same to be invested for Plts during their minority, and appointed Humphrey Aldridge Woodward of city of Dublin, Esq., and Robert Dey of city of Dublin, Pub. Not. to be exrs and appointed Plts mother Olivia guardian with said exrs of said grandchildren, and which will was proved in Prerogative Court by sd exrs. That said Testator intended by said will that the savings of said two estates so devised to Edward and Thomas Beatty during their minority should, after allowance had been made to maintain sd Edward and Thomas, be allowed to accumulate to increase the fortunes of the Plts. That without the aid of said savings the fortunes of Plts would be but trifling, the more especially because a sum of £5,000 part of the purchase of the Co. Wicklow estate which remained unpaid at the death of Edward Beatty has been paid out of his personal fortune. That Testator intended said residuary property should maintain said five grandsons and grand-dau. Olivia Beatty, and which residuary estate without the means as aforesaid is inadequate. That the rental of the Glynn estate produces £600 per an’m and the Co. Wicklow estate £500 per an’m. That said Trustee and Exrs considered that such allowance should be made to Pltfs. That said Woodward and Dey have possessed themselves of all the residuary estate and they with said Thomas Bell and said Edward and Thomas Beatty keep the savings of said two estates and Edward and Thomas Beatty insist they will retain said savings to themselves. Plts pray relief in the premises.
