After the death of George Beatty his papers came to the hands of Rev. George Crawford, one of his exors. who is married to a grand-daughter of sd George Beatty and said George Crawford in July 1808 hand the original will of Claud Beatty the elder to a son of Plt's as the will was required to prove a trial of an ejectment wherein the lessee of Plt's son Claudius Beatty and said George Crawford were Plts and one William Harkness Deft. relating to certain lands devised by said will and that was the first time Det. had seen the original will. That said will contains a clause as follows "I order my son George Beatty to be paid £5 yearly for his trouble about the said lease of Cloon and if said lease of Cloon should continue longer than the said George's life I order my son Robert to manage it and to have the £5 a year and after my debts are paid I order said lease of Cloon to go to my six sons, Viz: Archibald, George, William, John, Claud, and Robert Beatty equally, and in case before I die I consider to make a freehold lease to any of my said sons or sons-in-law of part of said lands of Cloon my will is such, free hold will abate out of his proportion of the profits of said lease so much in value as his freehold is worth yearly, so that all may have an equal share." Plt. furthur sheweth that when he saw the will the words "six" and "Claud" and "Robert" had been obliterated but no so much as to be entirely destroyed but that it was easy to perceive what the same were. That also in said will are two interlinations of words "Colt" and "Francis" which are above the signatures of the witnesses [i.e. had been inserted by George] That the trouble and expense of receiving the rents and managing said lands of Cloon would have been very inadequately recompensed to Plts. by said bequest of £5 a year if he had no further interest in said lands. That George Beatty after the death of his father said Claud the elder, by the death of his brothers the said Archibald, William, and John intestate and without issue become intitled to their share of said lands of Cloon and in 1773, the term which had subsisted in the case of Cloon not having expired. George Beatty who was one of the lives in the lease thereof did surrender same and obtained a new lease for 3 lives which lives are still in being and young and he for the rest of his life received the rents there of to a considerable amount. That George Beatty died in 1805 leaving considerable personal assets and made his will and appointed Francis West, McVitty Moore, and Rev. George Crawford his exors. and divided his interest in Cloon to his grandsons John West and Francis West, and Francis West having since died said John West is now intitled thereto, subject nevertheless is Plt's. claim therein, and subject also to a use for life to part of said lands deferred by George Beatty to said Francis West and Elizabeth his wife (who is daughter to George Beatty) That Claud Beatty the younger died in 1779 intestate and left issue two daughters his heirerses. That Elizabeth West and Frances Moore the wives of Francis West and Mc Vitty Moore are heirs at law of George Beatty. In as much as Plt had no opportunity to
