Beaty then of Balnamallard, co. Fermanagh, gent said house for the term of 4 years at
£2-5 pc rent who entered thereon and held same during said term and at the expiration of said 4 years Margaret Little or Thomas Wilson (who is nephew to Margaret and pretends to have a title to the premises) advertised in said town of Balnamallard and several other market towns in co. Fermanagh in Nov. 1765 to sell said lease and also one rood of bog in the lands in the lands of Sedair convenient to the town of Balnamallard. That several persons met at Margaret Little’s house and Thomas Wilson (who lived with his aunt Margaret Little and transacted her business) declared he would sell half an acre of bog in Sedair together with said house and that Margaret Little would assign over the original lease to the purchaser. That William Beaty of Killimilten, co. Fermanagh, bid £35-5/3 for the house and was declared the purchaser, but he was only purchaser for Rowland Beaty of Cavanagh, co. Fermanagh, gent., and Thomas Wilson when he heard Rowland Beaty was the purchaser declared he would abate one guinea of the purchase because of his friendship for Rowland. That Rowland Beaty looking upon himself as purchaser did in Feb. 1766 by indenture remise the premises to Plt. William Beaty for the term of 13 years from 1 May then next at £3-5/- rent and therefrom Plt. entered and was in possession for some time. That in May 1766 Rowland Beaty hand(ed) to Thomas Wilson
£20 part of the purchase money and soon after paid a further £10-1/½, in the whole
£30-2/½. That Rowland Beaty and Thomas Wilson settled to meet together at Inniskilling, co. Fermanagh in order to have a deed of assignment drawn up concerning the premises, and accordingly in Aug 1766 they met, in the town of Inniskilling, and the original lease from Connolly to Little was produced, but that Thomas Wilson after he had read over the deed of assignment objected to it alleging there was more acreage of the bog inserted in it than was sold, and would not sign same; John Henderson of Sedair who was present declared it was but half an acre of bog that was sold, and Wilson told Rowland Beaty if he did not like the bargain he (Henderson) would take it off his hands provided Plt. Wm. Beaty would give up the lease which Rowland Beaty had made to Plt., to which Rowland Beaty agreed that he would give over said bargain to Henderson. A few days after Henderson came to Plt’s house and demanded possession thereof from Plt, & Plt. replied he would not give possession thereof till 1 May next, and thereafter Henderson declared if he did not get possession at once he would not have anything to say to it. Soon after Rowland Beaty came to Plt’s house in order to get Plt. to go with him to Thomas Wilson to pay the remainder of the purchase money, accordingly Plt. went
