with him and Rowland Beaty told this Wilson he was ready to pay the remainder of the purchase money; therefore Wilson declared he wanted the whole purchase money notwithstanding that at the time of the sale he had abated one guinea. That after Plt. and Rowland Beaty left Wilson’s house, and going towards Plt’s house Rowland told Plt he would give Plt a bargain of said sale if Wilson would agree thereto, and Plt said that if Rowland would give up his purchase to Plt and would be out of the money until a bond which Plt then had in mortgage would come to his hands. That Plt would in the meantime give Rowland a bond from himself and his wife for the money, to which proposal Rowland agreed. That soon after that Plt. drew up a bond for £35-5/3 from himself and his wife to Rowland, which Bond Rowland Beaty accepted. That in Nov. following Rowland Beaty and one John Wiltaker came to Plt’s house when Rowland told Plt that said agreement did not answer him and he would be obliged if Plt. would give up the lease of the house to him as he had agreed to sell same to Wiltaker to which Plt. agreed if Rowland would return the above bond, and thereupon Rowland gave the bond to Plt., and Plt gave up the lease and was to deliver possession on 1 May next. That Wiltaker gave Rowland a guinea earnest on the bargain and Plt. executed a surrender on the trade of the lease to Rowland. That Rowland Beaty went into the kitchen where Plt’s wife was and told Plt’s wife not to be uneasy but that Plt. would have the first say in the sale of the premises if he would pay the rest of the purchase money to Wilson. That Plt’s wife informed Plt of this conversation and in January following Plt went to Rowland Beaty’s house and told him he had got £5-3/2½ to pay for the rest of the purchase money and would pay same if he would give Plt Wm. the bargain and Rowland said yes he would if Plt Wm. and his brother John Beaty would would execute a bond for £30 to which Plt. Wm. and his brother John agreed, and Rowland asked for and got the
£5-3/2½, and Plt. Wm. told Rowland if Margaret Little and Thomas Wilson would make a conveyance of said lease to Plt. Wm. he would not give Rowland any further trouble but would be concerned therein with Thomas Wilson alone. That on 20 January 1767 Plt. went to Wilson and said he had come from Rowland Beaty to pay Wilson the rest of the purchase money and accordingly paid £5-3/2½ to Wilson, and Wilson gave Plt Wm. a receipt for same dated 21 Jan. 1767, as received from Rowland Beaty at the hands of Plt. Wm. That thereupon Plt. requested Margaret Little to give him the original lease from Connolly and she gave same to Plt. That on 12 Feb. 1767 Plt executed a bond to Rowland Beaty in the penalty of £60 to pay £30. That
