(66) John Beatty, PLT. Robert Craig, Robert Galbraith, John Cranstowne, and
William Irwin, Defts. 20 Feb. 1701 [-2]
Plaintiff John Beatty of Aghaband, county Cavan, gent., Sheweth. That Robert Craig of Castlecraigh, county Cavan, Esq., in 1698 and for several years before was seized of an estate of inheritance of one pole of land called Aghaband, county Cavan, and being so seized PLT and Adam Noble, then of Aghaband, gent., applied in 1698 to Craig for a lease of said lands, whereupon Craig said he would make Adam Noble his tenant and would give authority to John Cranstown, gent., of county Cavan, to demise the premises to Noble and tha he would confirm whatever lease Cranstown made to Noble. That Noble on 15 Dec. 1698 treated with Cranstown for a lease when and agreement was made that Noble was to hold Aghaband for the term of 14 years from 1 May 1699 at 16 pounds rent and Cranstown promised to draw up a lease, said agreement being put into writing and signed by Cranstown and Noble. That afterwards Cranstown was applied to by one James Forbes for a lease of said lands but Cranstown told him that Noble already had a lease thereof, and if he wanted the lands he would have to go and see Noble, at same time giving Forbes a letter directed to Noble dated 8 Dec. 1699 in informing Noble of the conversation but that he (Cranstown) had no reason to complain of Noble as a tenant and was well pleased with him, and that when Forbes purchased Noble’s interest he would not move in the matter and further mentioned in said letter that as for one Irwin (a person who pretends a former agreement with Craig for said lands) he had no title thereto, as by said letter in the hands of Mr. Wm. Ritchison, PLT’s attorney may appear. That PLT desiring to purchase Noble’s interest in the lands applied to Craig to give his consent who willingly did so and said that as soon as PLT had purchased Noble’s interest he would give PLT a lease of the farm. That accordingly PLT purchased Noble’s interest by deed dated 8 May 1700, wherefrom PLT applied to Craig for the lease, who approved and said he would speedily make out the lease to PLT. That Craig wrote a letter to PLT. dated 9 Nov. 1700 whereby he promised to turn Irwin out of the premises and give PLT. possession as by said letter produced, may appear. That Craig desired Capt. Robert Galbraith, who was attorney or agent for Craig to turn Irwin out of the premises and put PLT in possession and to give PLT a lease. Now so it is Robert Craig combining with Capt. Robert Galbraith, and with John Cranstown and William Irwin in order to defraud PLT. has never executed said lease to PLT and refuses to do so and has given Irwin a lease thereof for several years.
