in pledge as aforesaid.  That by this means Plts got their liberty's but they have not paid said £50-0-6 nor are they liable by law to do so, said bond being extorted from them by force, but they are willing to pay the original contract price.  That Plt. Betty being under some difficulties at present and now actually a prisoner in gaol of Enniskellen for other debts, said O Donnell has lodged a marked writ agst Plt Betty and insists upon payment of the whole sum therein contained, because as he says the terms mentioned in said "defeasance" were not complied with, and also threatens to sue Plt on foot of sd bond.  Prays that writ may be gtd agst Manus O Donnell and Owen Tolan             Bill 7 Mch 1704[-5]

                  Plantiff, James Kennedy of the city of Dublin, Esq., sheweth.  That Lewis Craige, late of Ricarton in the kingdom of Scotland, was seized in fee of a considerable estate of the yearly value of £600 per ann. in Ireland, and there being a treaty of marriage with Margaret Dalglesh in
Scotland and said Lewis Craige  it was agreed that Lewis Craige should settle on her a jointure charged on his Scottish estate, which he did by deeds executed before their marriage and by said marriage he had issue by Margaret Thomas Craige and Robert Craige and several other sons and daughters.  That Lewis Craige died about 30 years ago, her children then being minors and in guardianship of said Margaret their mother who lived on her jointure charged on said Scottish
estate. That said Thomas Craige having died said estate in Scotland came to Robert Craige who came for Ireland in 1694 and did set and let his Irish estate. That Thomas Quin of city of Dublin, Alderman in Hilary Term 11th King Wm. III [1699] did ? judgement in the court of Exchequer against Robert Craige for £1000 on which judgement there
