or his agent Robert Fetherstin, a new lease in 1766 of County of Clooncaughill for 21 years at £56-4/- rents and he thereafter entered upon said lands and rec'd. the profits. That in pursuance of the trust vested in Plts. a deed poll dated 20 Dec, 1771 was executed by Hugh Rosborough to Plts. McVilty & Beatty that he rec'd said property in trust for his children by Margaret & that he would maintain, clothe & educate them, which deed was registered 11 Nov. 1778. That the lands of Clooncaughill produced profit of £40 yearly, and Hugh Rosborough has & doth still receive same to his own care, but he hath taken so little care of his children that Plt. George Beatty hath been necessitated to pay & advance sums of money to maintain, clothe, and educate 4 of said children (being the youngest of said five children) and also to advance Anne the eldest of them who hath lately been married to Robert Beatty and there is now due to Plt. Geo. Beatty for such maintenance _ £40, which sum Hugh Rosborough refuses to pay, but combiing with sd Robert Beatty & Anne his wife they refuse to come to any account with Plts concerning above trusts or to pay sd £40. = 18 Ap. 1780.
Amended Bill recites the above & adds that Plts. altho' they have requested Hugh Rosborough, he will not give up said care unless Plts. allow him £100 a year, and with intent to defraud Plts. has assigned said lease to his creditors, and doth declare that if Plts. persist in their suit agst. him he will totally desert his children,. Amendment - 18 March 1783.
