of Dromrane (3) That Plt. purchased Tullycossinbegg and 6 acres in Tullycossinmore from Robert Gryer, John Gryer, Robert Blake, Robert Johnston and Thomas Dodd, but does not know that Plt. ever enjoyed any number of acres in either of sd lands as guardian of David Betty. That Plt. agreed with Capt. Henry Hughes to claim said lands before H. M.’s Commissioners as well in trust for Plt. as for David Betty according to their respective proportion of sd lands. That £10 was paid by Plt. to Hughes as well for David Betty as for Plt. towards the charges and expenses which Hughes should be at to procure compensations [Could be “conformations” DWL] from the Commissioner and to secure letters patent for the lands, knows because this Deponent was present when Plt. sold butter, mault [sic] and bullocks to make up the £10 for Hughes. (4) Ever since this Deponent can remember Hughes, as in trust aforesaid, was possessed of 6 acres in Tullycossinmore but only these 3 years past. That Deft. commenced a suit against Hughes to recover 6 acres in Tullycossinmore and also 44 acres in Tullycossinbegg for Plt. That £20 was paid at several times to Deft. towards prosecution of the suit, that David Betty obtained a Decree for the lands and also for £50 for main profits thereof for the time that Hughes withheld them, and also costs of the suit. That Hughes delivered possession of the lands to Deft. and also paid sd £50. Deponent’s cause of knowledge that Plt. paid £20 to Deft is that Deponent was present and saw same paid and also saw a certificate from Pierce Birmingham, an attorney for Deft. wherein he acknowledged receipt of the money. (5) That Deft. promised and agreed with Plt. before the commencement of the suit agst. Hughes to give Plt. his due proportion, being 44 acres, out of Tullycossinbegg and Tullycossinmore and also a proportion of the main profits and costs when recovered. That Deft. has not performed sd promise. This Deponent, with one John Rutledge in 1667, being in Plt’s. house the Deft came to the house on his return from Dublin when he produced the Decree obtained agst. Hughes and read it twice or thrice joyfully before them all, and gave it to Plt. and his wife and bade them be merry and pay their debts for that he (Deft.) would willingly resign all up to them. Wherefore Plt. replied he would not desire any more than his own and afterwards got the Decree to take possession of the lands according to law, which possession he got together with bonds for payment of monies pursuant to the Decree from Hughes, which bonds Deft. pretended to give Plt. but within a fortnight after upon examining the papers. Plt. found but one bond and two other papers folded like bonds which were left in the chest. This Deponent was present when Deft. made an offer to give his right to the land if Plt. would give him his right to the bonds. That Deft. desired Plt. to let the monies and bonds go in his name till he had got a wife for thereby he might get a good portion, and that after he was married he (Deft) would not cheat Plt. of anything but would give all to Plt. again. To which Plt. replied he would not for that Deft. might get a wife without cheating. That Deft also spoke to this Deponent to desire Plt. to let all the money and lands lie in his name, as aforesaid, untill [sic] he had got a wife.
