The Court of Exchequer in Deft.’s name to be relieved agst. Capt. Hughes, and that Deft. was admitted in forma pauperis, but that Plt. should bear all charges and costs, and Deft should bear none. That a Decree was obtained against Hughes, and Deft. had the benefit Thereof. (10) Heard that the lands of Clooneene, barony of Tyroragh were set out as reprisals for the land of Corren.
Stephen Waggett of Cooloony, co. Sligo, gent. Aged 45. (1) knows Plt. and Deft. these 18 years. Knew the Earl of Carlingford. (2) Does not know the lands of Corren but that there were some acres set out to Deft.’s father in Tullycossin More, and that some were set out after his death. (3) That the Earl of Carlingford was restored by H. M.’s letters patent since the sitting of the Court of Claims, and that Deft.’s father had reprizalls left to him after his death. (4) This Deponent was present when Henry Hughes undertook to prosecute the Plt.’s and Deft.’s claims with as much effort as he did his own, they paying proportionately for their acres. That the half quarter of Tullycossin More and 12 acres in Tullycossin Begg belonged to Deft., but does not know what belonged to Plt. That Capt. Hughes upon their agreement was to get forth certificate and letter patent for sd lands. That by consent of Plt. the lands were to be claimed in Deft.’s name. (5) Has heard Plt. say he gave £10 to Capt. Hughes to procure a lease to him of the lands of Lislea from the Earl of Carlingford, and that the Debenture laid out to Deft.’s deceased father were part of Lislea. (6) nil. (7) That Henry Hughes did possess the lands of Leyney in his own name in his certificate and Patent, but what number of acres or upon what account does not know, but that he possessed same contrary to the trust reposed in him. (8) nil. (9) Knows there was a suit commenced agst. Capt. Hughes in the Court of Exchequer in Deft.’s name to recover sd lands, and that Deft. was admitted in forma pauperis, and that Plt. promised to assist Deft. so far as he could. And if the lands were recovered he would not ask any of them from him, for he had rather anybody should have them than Capt. Hughes. That a Decree was obtained agst. Hughes for the lands in the barony of Leyney, Deft. to have full benefit thereof. (10) Heard that Plt. had a reprizall for the land of Corran in Tyreragh.
Robert Hartt of Cappoge, co, Sligo, yeoman, aged 60: (1) Knows Plt. and Deft.. Did not know Wm. Betty. Knew the Earl of Carlingford. (2) to (8) nil. (9) That a suit was commenced by Deft. agst. Capt. Hughes, Deft. being admitted in forma pauperis. That Plt. was to bear the costs of the suit. That Deft. obtained a decree agst. Hughes and had the whole benefit thereof. This Deponent went to Plt. to get a lease of lands in Leyney who told this Deponent he should have a lease when David Betty came home but that untill [sic] then he could not have a lease for he (Plt.) had nothing to do therewith. (10) That Plt. upon the Earl of Carlingford’s account got a reprizall in Clooneene, barony of Tyrerafh for the lands in Corren and still keeps same.
Nichola Tamson, spinster, aged 20. (1) Knows Plt. and Deft. Did not know Wm. Betty nor the Earl of Carlingford. (2) to (5) nil. (6) Heard that 7 years ago there was an agreement between Plt. and Deft. made
