in Bally Mote about the exchange of Plt’s proportion of land in Tullycossin Begg and Tullycossin More in barony of Leyney for Deft’s proportions of land in barony Corren being part of Lislea together with the reprizall. Knows because this Deponent lived in sd house and heard the discourse of the exchange by the fireside and she saw Rory Hartt come to get a lease of Tullycossin Begg and Tullycossin More and thereupon Plt. told sd Roger Hartt he could not give him a lease for he had nothing to do with the land, and that if Deft. would not give him a lease he could help him get a lease for that Deft. had promised him a lease when the lands were recovered.
John Dempsey of Curew Nageeragh, co. Sligo, aged 30 (1) knows Plt. and Deft. Did not know Wm. Betty nor the Earl of Carlingford.(2) Knows the lands of Lislea in Corren being 50 acres, and 12 acres in Tullycossin More in barony of Leyney, and that same were set out upon the account of Deft’s deceased father for his service done in Ireland, and were set out after this death. (3) & (4) nil (5) Heard Plt. say he gave Capt. Hughes £10 to procure him a lease of Lislea from the Earl of Carlingford and that Plt. got the lease. (6) That about 6 years ago at Plt’s house in Clooneene this Deponent being a servant in sd house, heard Plt. say he would give Deft. his proportion of Tullycossin Begg and Tullycossin More for Deft’s proportion of Lislea in Corren. (7) nil (8) Heard John Rea 5 years ago declare he would assist Deft. about the suit and would not call him to account or desire any of the acres when recovered from Hughes. (9) nil (10) That Plt. got Clooneene for the reprizall of lands in Lislea and still enjoys same.
Cross Interrogations on behalf of John Rea, Plt. against David Betty, Deft
1.Are you concerned in this Cause or do you expect to benefit thereby in case the Cause goes on Plt’s behalf, which you cannot have or expect to have. In case the Cause goes on Deft’s behalf shall you loose or suffer loss, or if in particular hath not Plt. settled any lands on you in present possession or in reversion after his death. Thomas Rea of Clooneene, age 50, brother to Plt. John Rea, being examined “Swears to the above.”
John Rea, junior, son to Plt. John Rea, aged 23, Saith he shall neither win nor loose nor expect any reward from his father, Knows of no loss to himself if the Cause goes agst. Plt. That Plt. never promised nor declared to this Deponent to settle the estate upon him or of the posession [sic] or reversion thereof after Deft’s death.
