Did Claud Beaty by Anne McCally's persuasion decline to act as executor in 1722. Did not Claud Beaty in 1722 settle accounts with John Barrot, and what balance was due to Barrot in foot of said account, & to whom did Barrot assign his interest therein & for what consideration; and was not a part of said consideration given as a present to Anne McCally? What was the trust executed by Claud Beaty in 1722 and in what year was the consideration money paid to him? Did Aungier Gordon make a lease to Garret Cavenagh of the lands of Toreen and Lisnabararty and did not Claud Beaty agree with James Macartney to pay a yearly sum during said lease in lieu of yearly duties reserved in the lease, and Claud to have the benefit of such duty by virtue of a deed, produced, dated 16 Feb. 1725 [-6]. What application was made by Nicholas Cummin to James Macartney on account of the assets of Aungier Gorden, and was James Macartney in receipt of the rents of the premises mentioned in 2nd inventory by virtue of a mortgage and sale of the equity of redemption of sd lands; and did James Macartney allege Aungier Gorden owed him money and did threaten to sue the executors of Aungier Gorden for same, by virtue of letter, produced, dated, January 1725-6. Was said Nicholas Cummin involved on his own account in a law suit with James Macartney and did he during his life neglect to execute the trust reposed in him as executor of Aungier Gorden? When did Nicholas Cummin die, did he make a will and who are his executors? Is Claud Beaty alive? Did James Macartney during his life continue in possession of the lands in the 2nd inventory and receive the rents more than sufficient to pay off the mortgage? Did James Macartney make a will and are not Defts James Macartney and Hugh Henry his executors? View the deeds produced to you dated 2 & 3 July 1739, are you a witness? What were the lands of Killbride, Ballenecrosse and Toberphelim worth to be sold in from 1722 to 1732, from 1732 to 1733, 1733 to 1734 & 1734 to this day, and what were lands of Toreen worth from 1727 to 1736 and from 1736 to this day? Was Alexander Gorden one of the sons of Aungier Gorden and his reputed heir at law and has said Alex Gorden died without issue, and is Deft. Francis Gorden reputed heir to Alex. Was John Gorden by the will of Aungier Gorden disinherited and said James Macartney knowing such was the case purchased from said John Gorden his alleged equity of redemption to which he had no right. Did not James Macartney know Nicholas Cummin proved the will of Aungier Gorden. Entered 21 Sept. 1744.
