Elinor Betty swears that she and the other Plt. Mary Betty are intitled (sic) to their respective jointures charged on the lands of Tullycusheen beg (sic) and of 12 acres in Tullycusheen more, and that the Deft refuses to give this Deponent or the other Plts any allowance of the rents due to them and to which they are intitled (sic). Plaintiff Stearne (sic) Tighe of the city of Dublin, merchant, sheweth. That Plt. in 1742 purchased the lands of Gartlands town in the half barony of Fore, Co. Westmeath containing 600 acres and set a part of said lands called Corbally or Newtown (that he had before set to one Michael Dardis) to one John Brock, who by reason he was a protestant Plt. believed he would be an honest tenant, to hold said lands at 8/- per acre / altho’ (sic) Plt could have got 9/- per acre) exclusive of the bog, which rent was 1/- less than Plt could have got from another tenant, and Plt. agreed to give a lease for 3 lives. That pursuant to said agreement John Brock on 1 Feb. 1742 [3] entered into occupation of said lands. That Plt. did not know the acreage of the farm and a greed (sic) that Arthur Brock who was a near relation to John Brock, and whom Plt. believed to be honest was to survey the farm. Such was Plt’s confidence in the honesty of John and Arthur Brock that when the survey was made Plt did not go to inspect the same said survey having been made in May 1744 as by a map signed by Arthur Brock may appear by which it appeared the farm contained 49a.3r.10p exclusive of the bog (which contained 8a.1r.6p.) and therefore Plt consented to give a lease of the acreage as by said map which lease is dated 9 May 1744 to hold for the lives of the Rt. Hon. Charles Lord Tullamore The Hon. Arthur Dawson and the Hon. Richard Mountney, Esqs, two of the Barons of this Hon. Court, or for 21 years after the death of the survivor of them at 8/- per acre, amounting to 19 - 18/6??. That lately a map or survey of said lands was taken by one Hugh Reilly, being the map by which said Michael Dardis held the farm, and which has come to Plt’s hands, and Plt. found sd farm contained 64a. 3r. 34p. which is 6a. 3r. 8p profitable land more than the survey made by Arthur Brock. That Plt. applied to John Brock to pay up as the full acreage of the farm. Now so it is John Brock combines with Arthur Brock to defraud Plt. and will not pay on the full acreage of the farm. Prays for a writ agst the Defts. to answer in the premises. Entered 4 Feb 1746 [-7].
