Exchequer Bill:
Edward Beaty (sic) v. James McDowell, John McDowell, and John Orr 9 Nov 1753. In ans. Plaintiff Edward Beatty (sic) of Sess, Co. Tyrone, weaver, sheweth. That William McDowell late of Dervaghroy, Co. Tyrone, farmer, decd, being possessed of the lands of Sess and Dervaghroy, Co. Tyrone, and of other lands by lease of three lives yet in being held under Robert Lowry, Esq., he (Wm McDowell) some few years before 1750 agreed to set to Arthur Orr, late of Coolesker, decd, that part of said lands called the Sess of Dervaghroy, which John Cook then possessed at the same rent at which Wm McDowell held said part, and which was computed to be the quarter of said land. Accordingly by a writing was perfected by Wm McDowell to give a lease to Orr but by some omissions by the person who drew up the agreement same was not dated. That Arthur Orr became possessed of said land and did set a part thereof to Plt for the same term. That soon after Arthur Orr died and Wm McDowell thereafter possessed himself of the remaining part of said land which was so held by said John Cook which part Plt did not possess but same was possessed by an under tenant of the Orrs (sic). That Wm McDowell gave Plt receipts for Plt’s rent of part of the farm. That Arthur Orr having died intestate admin of his goods was gtd. (sic) to Plt. out of the Diocese of Armagh last January, and John Orr eldest son and heir of Arthur Orr by writing agreed that Plt. should enjoy all (sic) the land so demised so demised (duplicate sic) to Arthur Orr in as much that Plt. had paid a fine of 3 guineas on account of Arthur Orr during his lifetime. That Plt. frequently applied to James and John McDowell to give him possn of the remainder of said lands so possessed by John Cook, to give Plt. a lease thereof but they refuse. That James McDowell last August wrote to Plt. that as his father and said Arthur Orr were both dead Plt had no right to sd lands. Now so it is said James McDowell, John McDowell and John Orr combine to evict Plt. out of the lands. Prays for writs agst them to answer in the premises. Bill entered 9 Nov 1753. John Beatty the younger of the town and Co. Monaghan, gent. and Protestant of the Church of Ireland , sheweth. That Oliver Anketill of Anketill’s Grove, Co. Monaghan, Esq. being seized of the town and lands of Lower Brackagh and Aughefad??, situate in the psh of Aragle??, co. Monaghan, by a lease dated 10 March 1746 [-7] to farm out to Hugh Sweeny of Gallanagh, Co. Monaghan, gent. said lands of Lower Brackough and Augheford for 31 years from 1 May next
