fell sick in Dec. or Jan. 1731, and being in a weak condition and impaired in his understanding Arthur Beatty took advantage thereof having long before known Charles had made said will and bond in favor of Wm Smith, did prevail on Charles Beatty to make another will in favor of him Arthur Beatty, by giving out false reports against Plt John Smith and his mother Anne Smith to Charles Beatty in order to withdraw his affection from them. That Arthur Beatty effected his purpose but Charles Beatty told Arthur he would have to go to law with Plts to which Arthur answered he would make one if his sons a lawyer to which Charles Beatty said: give me your hand on that and I will do anything you have me. Accordingly some little time before he died Charles Beatty signed a will [which he never read, i.e. to that effect, recitals tedious]. That Charles Beatty died 9 January 1731 and Arthur Beatty immediately proved the will in the diocese of Kilmore & Ardagh with utmost expedition; he Arthur Beatty and Wm Tweedy being exors and possessed themselves of the effects of Charles Beatty to the value of 2,000 & upwards. That as exors of Wm Smith Plts have commenced a suit at law agst (sic) Arthur Beatty & Wm Tweedy as exors of Chas. Beatty in the pleas of this court in Trinity term 1732 and filed a declaration on said bond. Now so it is Arthur Beatty& Wm Tweedy combining with Mary Beatty, Edward Beatty, Charles Beatty, James Young, John Irwin, Claud Beatty, Henry O’Neile (sic), Robert Beatty, and Wm Beatty, in order to defraud Plts, to which Arthur Beatty & Wm Tweedy have pleaded plena administraverent??? to Plts declaration. That Plts have replied thereto and said suit is at issue, the Defts pretending Charles Beatty died much in debt. That Arthur Beatty has drawn up an inventory in which he has omitted many effects [here follows list of minions? including silver hilted sword and other silver articles] and which inventory has been scrutinized by some of the other Defts. That the inventory was so palpably doctored [some details at length] one of the Defts refused to sign it in as much that Arthur Beatty had under valued the goods of Charles Beatty by underhand means, he having brought down the inventory to a small amount. That Arthur Beatty says he will keep Plts at law and will make over what he has to his own children and Plts will never get a farthing. The truth is that Charles Beatty owed few or no debts at the time he died, and was possessed of the lands of Farranseer and Enagh, Co. Cavan, worth 20 prop?? and left 250 in cash delivered before he died to Wm Tweedy, and 100 more in his drawers, plate, silver, &c.&c. in large gratuities and a large farm stock [much detail and how Arthur Beatty auctioned same at a low price buying it himself] and many debts due to him; including a considerable debt due to him by Arthur Beatty Jr the rest of the lands of Lacken which did belong to
