advertised in the town of Monaghan his intention to sell said tenentand Plt. became purchaser there of for £301. That after the sale Viz: on 17 Aug. 1737 Edward Ellis executed an agreement to Plt concerning the purchase whereby he agreed to convey to Plt his title to the whole interest of said tenent which was then in possession of said Edward Ellis, Frances McKenna, and Thomas Rogers, and Edward Ellis assured Plt he was intitled to the whole tenant. Accordingly by deed by of Lease and Release dated 15 & 16 Sept. 1737. Edward Ellis released to Plt the premises and at same time Plt. in order to secure the purchase money to Edward Ellis executed a bond to him in the penalty of £602 to pay £301. That since the execution of said deeds Plt. has been in formed that Rebecca (who married before she was of her full age of 21) had a claim to the premises. That Arnold Cosby is said dead and Rebecca has since intermarried with John Harpar of Inell, co Louth, Esq. That Plt. has requested Edward Ellis to prevail on his sister Rebecca and her present husband to concur in the fine to make Plt a good title to the premises to which Edward agreed. That Counsel has declared that said deeds of 1737 are defective and Plt has requested Edward Ellis to execute a proper deed which he has promised to do; Plt has prepared same but could never get them executed. That Edward Ellis at the time he excuted said deeds of 1737 owed money to several persons Viz: to Bratazon Noble, gent., attorney of this court upon a judgment attained in Mich's term 1735 on a bond for £103--1/4; to Thomas Newbitt on a judgement obtained in Common Pleas in Hillary term 1736 for £200, which debt was assigned to Richard Ellis in Mich’s term 15th year of the present reign. That Plt has paid upon said judgement and also on another for £45--16/6 at the suit of Thomas Nesbilt agst Edward Ellis on a judgement entered in Hilary term 1738. That Plt has paid for Edward Ellis the sum as per schedule in the whole amounting to £223-16/3. That a judgment was entered in Trinity term 1738 against Edwd Ellis at the suit of Richard Ellis for £640 and another judgement in Easter Term 1745 ajst Edwd Ellis at the suit of Ralph Semple for £40--17/4; also another judgement agst Edwd Ellis in Trinity term 1746 at the suit of Richard Dawson of Dublin for £400. That Plt. has paid so much [i.e. £223--16/3] of the said purchase money on foot of said judgement and Edward Ellis has assured Plt he will satisfy same and give Plt. a good title to the premises. That Edward Ellis prevailed on Plt. to be his bailsman in 2 promisory notes of £50 to Bralazon Noble, gent. and Hugh Willoughby, Esq. and in a bond called a Kerry Bond for £50 to sd Bralazon Noble, and now Edward Ellis refuses to pay on same. That said several judgements are incumbrances on Plt. said purchase. Now so
