and John Barrett ought therefore to discharge the second bond. That Clifton pressing for payment of same said John Barrett or Anne Smith alias Barrett his mother did some time past as, alleged, pay off the same, and did take an assignment of said bond made to said Anne Smith alias Barrett in trust for John Barrett or for said Anne. That John Barrett by letter dated 15 Aug. 1727 acquainted PLT. that he did assign his (Barrett’s) demands upon PLT on account of said security entered into by PLT and John Barrett to Clifton unto his said mother and that she did intend to send her son Richard Barrett to Plt’s house there to diet and lodge with PLT until the money due upon the second bond should be thereby discharged. That Anne Smith alias Barrett also wrote another letter to PLT to the same effect. That accordingly in Aug. 1727 Richard Barrett came to PLT’s house at Kilbride where he remained till the latter end of February following being upwards of 7 months during which time PLT. fed and lodged him for which PLT does reasonably charge John Barrett and Anne his mother the sum of £7. That Richard Barrett being then a youth of about 24 years of age and PLT had paid out money to clothe him at the request of Anne Barrett alias Smith and John Barrett amounting to 13/6 as by receipt signed by Richard Barrett and now in the hands of Mr. William Wall, PLT’s attorney may appear. That PLT in February 1727[-8] lent Richard Barrett in order to defray the expenses of his journey to Dublin 5/5; and also paid to him to hire a horse a further sum of 5/5. That John Barrett or Anne Smith alias Barrett in the latter end of 1728 delivered to Charles Beaty of the city of Dublin, apothecary, the said last mentioned bond with authority to call upon PLT to receive from PLT some balance pretended due thereon, which bond Charles Beaty gave to his brother Robert Beaty who under colour thereof stopped and detained from PLT £2-2/2 in the month of April 1729, which sum of £2-2/2 said Robert Beaty or Charles Beaty as administrators of their late father John Beaty, deceased, then owed to Plt. for tithes of the lands of Springtown, county Longford, and which sum they paid to John Barrett or Anne Barrett alias Smith. That PLT in July 1719 paid to John Barrett 5/5 and paid for 2 pair of yarn stockings for use of said John Barrett 2/8 ½ in part to discharge said last mentioned bond; which sums in all amount to £10-15/7 ½ and which overpaid and discharged said last mentioned bond, which bond John Barrett himself ought to have paid, in as much as PLT had already paid off the first bond. Now so it is John Barrett and Anne Smith alias Barrett combine with Charles Beaty and Robert Beaty and with Isabella Beaty widow and John Clifton to defraud PLT in as much as John Barrett or Anne Smith alias Barrett have lately entered judgment in the Court of Common pleas of this Honorable Court on a counter bond alleged to be by PLT. executed to John Barrett in the penalty of £23-0-8 to pay said two several sums of £5-15/2 to Clifton
