Premises upon redemption of the mortgage. That this Dep't was in the town of Enniskillen about the year 1699 in the house of David Gibson in company with John Johnston, son to Plt. Samuel, when he saw John tender £10 to Deft John Betty to pay for said arrears of rent and redeem the mortgage, but Betty refused to accept it. That Defts John Betty, Rowland Betty and James Johnston have no title for what they do except under Plt. Sam Johnston [Signed] John Irvin.
James Cooke of Tullynegan, Co. Fermanagh, aged 60. Knows all the parties there 25 years because he lives in their neighborhood; and knows the lands of Tullycallrick 23 years. Has seen Plt. Sam Johnston living on sd lands and that he derived his lease thereof in fee farm from Henry Blenerhaset at £5-12/- yearly rent. That Deft. John Betty let the lands for 8 years at £5 rent to Patrick M'Anaran and partners, but that at the expiration of 6 years he raised the rent to £9-10/-; knows this because this Dep't is a tenant on Tullycallrick. Interrogations on behalf of Plt: --
Did you know Henry Blenerhassett and Phebe his wife? Do you know the lands of Tullycalrick, Co. Fermanagh? Was Plt. Samuel Johnston seized of said lands, under whom, and in what year, and particularly when was Plt. in arrears to his landlord, was it in the year 1686? When was Deft John Betty agent or receiver of rent of said lands and for whom did he act? When did Plt make over sd lands of Tullycalrick to Deft. John Betty, and for what sum were same mortgaged to him with proviso of redemption; and which of the Defts promised to execute a deed of the lands or give a promissory bond to Plt. to re-assign the lands on Plt's redeeming the mortgage. Which of the Defts are witness to a deed now produced to you, and upon what account was said deed executed. Entered 11 June 1711.
Depositions on behalf of Plt. for the lands of Tullycallrick, Co. Fermanagh against the Defts., taken before Guy Carlton, gent., Alexander Calhoun, Clk, Com'r for Plt. and Robert Richardson, gent., and James Foster, merchant, com'r for defts by virtue of a commission out of the Court of Exchequer dated 5 June 1711. Witness examined at the house of Gayer Blackly in Lowtherstown, Co. Fermanagh on Monday 18 June, 1711.
John Johnston of Kilterny, Co. Fermanagh, aged 36, knows Plt. Samuel Johnston and Deft. John Beatty since he was a boy knew Phebe Blenerhasset about 18 years, knows the lands of Tullycallrick about 16 years because he always lived in that neighbourhood. That about 8 years ago Plt. Sam Johnston was seized of said lands under Henry Blenerhasset, Esq., and became in arrear of his rent to Phebe, widow of Henry Blenerhasset, Esq.; for £10.
