Commission out of the Court of Exchequer dated 5 June 1711, taken at the house of Gayr Blackly in Lowtherstowne, Co. Fermanagh on 18 June 1711.
John Betty of Shianfin, Co. Tyrone, aged 50, knows Plt. and Deft. John Betty 20 years, because he lived in their neighborhood about 11 years, and was acquainted with them before he was their neighbor. That Deft. John Betty was agent for Phebe Blenerhasset in the Manor Hassett. Knows the lands of Tullycallrick 20 years, that Plt. had a freehold interest therein from Henry Blenerhasset Esq., because this Dept. lived in that neighborhood for 11 years. Knows that a deed of conveyance was executed by Plt. Sam. Johnston to Deft. John Betty of said lands, having been present when same was executed and then heard that Plt. owed £10 arrear of rent to Phebe Blenerhasset. Does not know of the condition of Plt. Sam Johnston when the conveyance was made by him or his son John Johnston to Deft. John Betty. That Deft. John Betty conveyed said lands to James Johnston of Drumkeen, Co. Fermanagh in consideration of a sum of money for which James Johnston had become bound for Deft. John Betty, because this Dept. was a witness to said lease, and by order of Deft. John Betty gave ??? ??? of Tullycallrick to James Johnston. This Dept. was a witness to the conveyance executed by Plt. Sam Johnston and his son John to Deft. John Betty of sd lands for £10 consideration to pay said arrears, and heard Plt. after executing same demand 10/- from Deft. John Betty for earnest money which was in 1692. That Plt. Sam Johnston has dwelt there 2 or 3 years past on Tullycallrick. That one or two years after Deft. John Betty so purchased said lands he offered to sell his goodwill therein to this Dept. for 10 guineas yearly, at the rate of one guinea a year, and this Dept. paid one guinea in earnest of said bargain, but afterwards by the advice of his friends he relinquished the treaty as he feared trouble with Plt. Sam Johnston and got his guinea returned. [Signed] John Betty.
James Cooler of Lyan, Co. Fermanagh, farmer, aged 60. That Deft. John Betty is agent to Phebe Blenerhasset. Knows lands of Tullycallrick, 24 years. That Plt. Sam Johnston possessed same by inheritance from his father who held a right thereto in fee farm from Henry Blenerhasset, Esq., and that the profits of said lands in 1692 and for 2 or 3 years after were not worth anything like the reserved rent, being too dear, knows this because the Dept. was a tenant on Tullycallrick under Deft. John Betty at £8-12/- rent. Has heard that Deft. John Betty purchased Plt. Sam Johnston's interest in the lands for £10 arrear of rent, which sum this Dept. believes was too much for same; knows this because he heard Plt. offered said lands to David Irvin and that after the bargain was made between Sam Johnston and David Irwin that Quarter Master Irvin, said David's brother, caused same to be relinquished because it was too dear. That Plt. Sam Johnston was in a poor condition
